According to Georgian legislation, in order to participate in the surrogacy program, it is necessary:
1. Potential parents must have a registered marriage at least one year ago. ( For Georgian citizens, it is also possible to present an official document of marriage registration from the Patriarchate of the Georgian Orthodox Church ).
2. It is necessary to register a notarial agreement with the surrogate mother.
3. When registering a notarial agreement, it is necessary to sign the agreement by all three parties, either personally by the potential parents or by a notarized authorized person. The presence of an authorized person by the surrogate mother is not considered when signing the notarial agreement.
4. According to Georgian legislation, when a child is born through a surrogacy program, the potential parents are registered as parents in the birth certificate and the birth certificate will not indicate any information about the surrogacy program or the surrogate mother.
5. The surrogate mother's consent is not required for the registration of parents in the child's birth certificate.
6. If the child was born through a surrogacy program, or the embryo was obtained through egg or sperm donation, only the potential parents will be registered as potential parents in the birth certificate and no information about the donation program will be indicated anywhere in the birth certificate.
7. The child's birth certificate will be issued as soon as possible after the child's birth,
within 1-5 days
8. The birth certificate of a child born through a surrogacy program is no different from the birth certificate of any child born in Georgia.
9. The following documentation is required for registration as parents: a notarized agreement with the surrogate mother, a transfer certificate issued by the clinic where the in vitro fertilization and embryo transfer into the surrogate mother's uterus were performed.
10. Foreign citizens should then take the birth certificate of a child born in Georgia to their country's embassy in Georgia.
